Appellate Law
New York State has a number of appellate courts, generally organized in a three-tiered system. In the first tier, or lower tier, are the various trial courts. Cyberlaw/Internet Privacy and Cyberbullying
There are vast risks attendant with social media sites, and cyberbullying and cyber-stalking are two of the larger risks. Cyberbullying can take place on popular social media sites. It has been reported that youth spend more time with media than any single other activity, except for sleeping. Consequently, this past decade there has been a significant surge in the number of reported incidents of cyberbullying; bullying that occurs through the use of electronic communication technologies, such as e-mail, instant messaging, social media, online gaming, or through digital messages or images sent via cellular telephones. Cyberbullying also commonly takes place through the use of websites belonging to certain groups, used and directed at maliciously targeting another individual or group.
Cyberbullying can be more disruptive than face-to-face threats and harassment because abuse that occurs electronically has certain unique characteristics. Almost every blogger or comment writer posts anonymously. By contrast, the schoolyard bully is usually relatively easy to identify, which differs from cyber bullies who regularly hide behind anonymous or fake user accounts and profiles. Indeed, behind a shield of anonymity, a bully might be bolder, and more cruel, than he or she would dare be if faced with the victim in person.
The Internet provides a wider audience for abusive or humiliating posts, especially on social media websites, where often anyone with Internet access can see messages and other information. Similarly, data posted online never really goes away, even with efforts to be “deleted” — An attribute of electronic media that can come back to haunt victims and bullies for years to come. It may even affect potential future employment opportunities, as employers commonly use Internet searches to screen job applicants.
The consequences of cyberbullying depend heavily on the circumstances of the offense. A disruptive cyberbullying incident may be addressed and settled under school policy, but more serious cases often land in civil and criminal courts. In most states in the USA, a victim of cyberbullying or cyber-stalking may bring a civil action against a bully for the defamatory, reputational, emotional, social and financial harms caused by cyberbullying. Alternative Dispute Resolution
When business disputes arise, parties often agree contractually to resolve them through arbitration.
