Appellate Law

New York State has a number of appellate courts, generally organized in a three-tiered system. In the first tier, or lower tier, are the various trial courts. The middle tier of appellate courts, or intermediate appellate courts, consists of the Appellate Divisions, Appellate Terms, and the various Judicial Districts throughout the State. The highest court in New York is the New York Court of Appeals, situated in Albany, New York. Whether you have been convicted of a crime, or involved in a civil dispute, and are seeking to appeal, knowing which of these appellate courts will have jurisdiction to hear your case is the first essential step to a successful appeal.

If it is an appeal of a criminal conviction, your liberty may be at stake. If your case involves a civil dispute, there is likely a substantial amount of money involved. Success on appeal is much more than a matter of simply pointing out some unfairness at the lower court level. It requires identifying, specifically, and asserting to the appellate court the actual legal errors that substantially affected the outcome of your case.

Founded on more than two decades of service, combined, as a former prosecutor in the Brooklyn District Attorney’s Office, senior law clerk for the New York Court of Appeals, and as a New York litigation attorney, the Law Office of Aaron Pam, Esq., is prepared to guide you through the intricacies of New York State’s appellate court system, to work with you to develop your strongest legal arguments, to zealously present those arguments to the appellate courts, and to use my knowledge of the legal process to identify such errors and file the right paperwork for your appeal.

Cyberlaw/Internet Privacy and Cyberbullying

There are vast risks attendant with social media sites, and cyberbullying and cyber-stalking are two of the larger risks. Cyberbullying can take place on popular social media sites. It has been reported that youth spend more time with media than any single other activity, except for sleeping. Consequently, this past decade there has been a significant surge in the number of reported incidents of cyberbullying; bullying that occurs through the use of electronic communication technologies, such as e-mail, instant messaging, social media, online gaming, or through digital messages or images sent via cellular telephones. Cyberbullying also commonly takes place through the use of websites belonging to certain groups, used and directed at maliciously targeting another individual or group.

Cyberbullying can be more disruptive than face-to-face threats and harassment because abuse that occurs electronically has certain unique characteristics. Almost every blogger or comment writer posts anonymously. By contrast, the schoolyard bully is usually relatively easy to identify, which differs from cyber bullies who regularly hide behind anonymous or fake user accounts and profiles. Indeed, behind a shield of anonymity, a bully might be bolder, and more cruel, than he or she would dare be if faced with the victim in person.

The Internet provides a wider audience for abusive or humiliating posts, especially on social media websites, where often anyone with Internet access can see messages and other information. Similarly, data posted online never really goes away, even with efforts to be “deleted” — An attribute of electronic media that can come back to haunt victims and bullies for years to come. It may even affect potential future employment opportunities, as employers commonly use Internet searches to screen job applicants.

The consequences of cyberbullying depend heavily on the circumstances of the offense. A disruptive cyberbullying incident may be addressed and settled under school policy, but more serious cases often land in civil and criminal courts. In most states in the USA, a victim of cyberbullying or cyber-stalking may bring a civil action against a bully for the defamatory, reputational, emotional, social and financial harms caused by cyberbullying. In civil court, a judge or jury may award money damages to be paid to the victim; for example, to compensate the victim for the cost of therapy for the emotional trauma that the bully caused the victim, for the cost of harm to the victim’s reputation and/or business and professional interests, or to pay for property damage caused by criminal conduct.

Commonly, initial legal issues arise in determining the identity of a particular cyberbully, and being able to determine when the identity of an anonymous Internet speaker may be disclosed to a potential plaintiff seeking to assert a civil claim for damages, where the courts must strike a balance between the well-established First Amendment right to speak anonymously and the right of the plaintiff to protect his or her proprietary interests, reputation, and overall health and well-being, through the assertion of cognizable legal claims.

By successfully obtaining a court order compelling the disclosure of the anonymous “user’s” basic subscriber information, IP addresses/internet protocol addresses, meta data and/or similar information sufficient to allow for identification, and requiring the preservation of all evidence in connection with your case, the Law Office of Aaron Pam, Esq., can assist you to be able to properly name the potentially responsible individuals and proceed to prosecute your civil claims in a court of law. Far too often, without adequate and experienced legal counsel, many incidents of cyberbullying, victimization and cyber-victimization are allowed to continue unabated, heightened and exacerbated by inaction, while the victim’s “day in court” is forever denied.

Anonymity of the cyberbully or anonymous poster will not prohibit your case from going forward. In fact, the Law Office of Aaron Pam, Esq., has succeeded in uncovering anonymous posters and pursuing them for damages, and defending individuals and business clients from the false and defamatory blogs or posts remaining online, with the penultimate goal of removal of the defamatory blogs or posts, so that they will never again appear in a search result online.

Founded on more than two decades of service, combined, as a former prosecutor in the Brooklyn District Attorney’s Office, senior law clerk for the New York Court of Appeals, and as an experienced New York litigation attorney, the Law Office of Aaron Pam, Esq., is prepared to guide you through the intricacies of New York State’s appellate and trial court system; to work with you to identify and develop your strongest legal arguments; to zealously present those legal and procedural arguments to the courts; and to use learned knowledge and broad experience of the legal process to assist you to prevail in court.

Alternative Dispute Resolution

When business disputes arise, parties often agree contractually to resolve them through arbitration. Arbitration typically promises faster, more cost-effective and confidential resolutions than traditional litigation. Some potential downsides are that parties generally cannot seek to overturn unfair or incorrect decisions made by an arbitrator, discovery rights are limited, and parallel proceedings in court may still occur.

The Law Office of Aaron Pam routinely arbitrates claims both on the claimant and respondent side, and has been engaged in arbitrations involving commercial contracts, real estate, employment matters, and general business arbitrations. As an experienced trial attorney with a reputation for intensive investigations, thorough preparation and aggressive advocacy, the Law Office of Aaron Pam enjoys an impressive record of courtroom achievements and settlement victories, including by being extensively familiar with the procedural and substantive elements of arbitration proceedings, and by recognizing the importance of the judicious use of arbitration proceedings and mediation efforts in seeking to resolve a dispute.

In mediation, the mediator, acting as a neutral, is selected to assist the parties to try and reach a mutually acceptable resolution to their dispute. The mediator does not decide the case, but rather facilitates the discussions between the parties. In arbitration, the arbitrator renders a binding decision. Arbitration is a private and less costly alternative to the more formal nature of court proceedings. Resolving a legal dispute through alternative dispute resolution (ADR) generally avoids the expense, publicity and significant delay of a trial, by providing a faster process toward reaching a conclusion and limiting grounds for appeal.

In seeking to evaluate and advise toward the most appropriate and effective litigation strategies to employ, the Law Office of Aaron Pam consistently seeks to optimize case outcomes, while mindfully managing the significant costs, time and stress of a lawsuit on clients, and routinely uses arbitration, mediation and other forms of ADR as some preferred and pragmatic ways to achieve our clients’ goals.

In addition to counseling clients on how best to incorporate ADR into their routine business practices – including analyzing factual and legal issues, drafting mediation and arbitration clauses in numerous types of agreements, ranging from commercial contracts, consumer agreements, and employment agreements to written settlement agreements –Aaron Pam, Esq., has experience in using arbitration and mediation to successfully resolve both business and personal disputes. Whether your particular dispute requires successfully enforcing an arbitration provision, or prosecuting or defending a claim in arbitration, Aaron Pam, Esq., is highly experienced in developing strategies to resolve complex disputes, including those involving multiple actions, multiple claims, multiple parties, multiple jurisdictions, and parallel and/or related arbitral and judicial proceedings, on behalf of large corporate, small-business owner and individual clients in federal, state and appellate courts.

As an experienced New York litigation attorney, Aaron Pam, Esq., has pursued and defended claims before numerous arbitral bodies, including JAMS and the American Arbitration Association (AAA). These claims have involved major contracts, licensing agreements, financial agreements, real estate disputes, construction, insurance, and private employment matters. Consistently, my stated goal is to enable my clients a strategic and targeted range of lawful options in litigating their disputes, including competently preparing and confidently going forward to trial and/or working toward reaching a favorable settlement agreement during trial, pre-trial settlements and plea bargaining, and/or seeking an alternative resolution through arbitration and mediation services.
